In the article 'Sources Of Legal Regulation Of The International Commercial Arbitration In Egypt' by A. V. Yakovlev general characteristics of regulatory documents in Egypt is described, the pecuilarities of the legal documants are well explained, what is the main theme of my course paper. Yakovlev states that international commercial arbitration today is the most effective and efficient way to resolve disputes arising in the field of international trade as it is able to solve conflicts in an impartial manner. He writes that the legal model of the Egypt atbitration may be a good examle for the Russian legislation as it is famous for its demonstrating of the greatest success in providing services in the field of alternative resolution of commercial disputes. The author also explains that pecularities of the Egyptian legiclation is a result of its historical development, during which it borrowed some features from Sharia law, French law, socialist arbitration system.
Yakovlev explains in detail that the in the Egyptian legislation the ideas of Sharia law can be traced, which main feature is rather the arbitration in equity, than the arbitration in law. The first one is conducted by friendly mediation, while the second is used only in special cases-procedure is based on the methods of the exclusive application of the law. Another feature is Egyptian principle of autonomy of the will of the parties, which should be implemented during international commercial arbitration, which idea is that only the parties can, by their agreement, initiate arbitration and select an arbitration organization that will consider the conflict.
The article was useful to me since I was confronted with terms from the legal sphere, which is very useful for writing my term paper (The Basics of International Legal Documents) and I understood how much I should know not only about linguistics, but also about law. I was interested to know that international arbitration can be based on religious rules and thus improve its effectiveness.
After reading this article, I had the following questions:
1. Do the characteristics of the Orthodox religion reflect in the laws of the Russian Federation?
2. Why Russian legislation cannot borrow successful innovations of foreign countries to improve office efficiency?
